Doctors unfamiliar with the laws governing pedestrian accidents often do not get paid for their work. Here is the reason why:
Pedestrians have the right of way over cars in a crosswalk. Automobiles have the right of way over Pedestrians who are outside of the crosswalks.
This means that Pedestrians who cross the street outside of a crosswalk rarely win a recovery if they are struck by a car.
Doctors should not rely on an Assignment and Authorization to get paid in Pedestrian cases if their patient was outside of the crosswalk.
The problem arises when an attorney who is not familiar with pedestrian law takes the case, signs the assignment and authorization for the doctor, and assures the doctor that he or she will get paid at the end of the case. In reliance upon the lawyer's statements, the doctor treats the patient. Six months later, the doctor gets a call from the lawyer who states that they have reassessed the case and have decided that they are going to stop working on the case. This is bad news for the doctor who now has no way to get paid the enormous bill that has been incurred.
